The English precedents were relied on repeatedly by Indian courts as well. Tax avoidance was thus seen as a permanent right of assessees. Then came the turbulence, temporary though. The Supreme Court, in the McDowell Co Ltd vs CTO (1985 154 ITR 148 SC) case, said that time has come to depart from the old thinking. It said even tax avoidance is bad and deserves condemnation. The apex courts justification for this being, the House of Lords, the highest judicial forum of English, has given a go-by to the principle laid down by the British courts (in Duke of Westminster case). Since tax avoidance as a legal route was rejected by the very country of origin, it does not merit any better treatment in India, the Supreme Court held. The adverse legal consequences of this judgment for taxpayers were enormous. First, it came from the highest court of the land and, therefore, binding on all lower courts and Tribunals. Two, the McDowell case blurred the distinction between avoidance and evasion. The Department, of course, welcomed the ruling. It repeatedly tried applying this case, as only the Supreme Court can undo the McDowell case, if at all. And fortunately the apex court did reverse the findings in the McDowell case in Union of India vs Azadi Bachao Andolan (2003 132 Taxmann 373 SC). It was argued before the Supreme Court that the McDowell case had changed the face of fiscal jurisprudence in the country. Therefore, for any tax planning, the court must strike down what is intended to and results in avoidance. Rejecting this argument, the apex court upheld the legitimate rights of taxpayer in tax avoidance. In the process, it found that the McDowell ruling was nothing exceptional but only an exception to the well-settled law.

During this time the United States was faced with another obstacle. It changed America in many ways. One hard struggle lead to the next. The later events all started with the crash of the stock market. This period can only be explained by its name. So, the stock market crash in the United States caused businesses to close, banks to fall, and many people to become unemployed, causing this twelve-year period of suffering to become known as ?The Great Depression?. As stated by Nelson Cary in his overview of the Great Depression, ?the core of the problem was the immense disparity between the country?s productive capacity and the ability of people to consume?. There were more introductions of new items in the United States than before, during, or after World War I. The Government had tremendous debt from this war. The economy suffered greatly during this time because of the immense deficits left from the war. The farmers and the wage earners received printed money that actually had no true value. The overproduction made the lower class, such as farmers and trade smiths, become part of the higher class. Therefore there was not a balance between lower and higher, thus making the market tip. The bottom line was that paper money at that time had no real value. So, even if you had money, people would not take it because there was not a balance for the banks to stand on. Most people then were categorized to be in the lower class. So now, once again there was not a balance between lower and higher class. All people experienced suffering. ?Broth... ...bout 800,000 people left Arkansas, Texas, Missouri, and Oklahoma. The government then abandoned the AAA act when the tax on food processors was ruled to be unconstitutional. As you can see, the United States of America has changed greatly since the Great Depression. Our idea of what we need and what is poor has changed greatly since this period. This twelve year time period shows how things can change, and how people can adapt to economic crisis when they are forced to. Without our fall, other countries may have experienced this. So, this period of American history still serves as a lesson today. As quoted by many people, ?If we do not know our history, we are destined to repeat it?. In conclusion, you can see the Great Depression caused great calamity and sorrow, but in the end, it was one of the best learning experiences the United States has ever seen.

Women become more aggressive and assertive because they don't want to be treated unfairly and women taken serious. Compound Tenses in English Grammar In English grammar, compound tense is a traditional term for a verb construction that uses more than one word to express a meaning related to time. A verb construction that uses only one word is called a simple tense.Compound tenses are made up of auxiliary verbsà (or helping verbs) combined with other verb forms. The perfect, past perfect (also known as pluperfect), progressive, and (in some cases) future are forms traditionally regarded as compound tenses in English. Gross National Income of different countries - Statistics Project Example Data was collected by the World Bank Organisation about the Gross National Income, expressed in purchasing power parity dollars to adjust for price level differences across countries. The data is not adjusted for inflation. There are values for each year from 2001 -2009 for each country. The numbers are measured in millions of dollars. Analysis is conducted taking the 2008 values only. The data has been acquired from the World Bank Organisation. The analysis is conducted on the data for the year 2008. The data is a sample of Gross National Income of selected 173 countries. The methods employed are analysis of summary statistics, analysis of frequency table and histogram and the analysis of line graph of Gross National Income. Results In accordance with the descriptive statistics demonstrated in Table 1, the following relation can be ascertained: Mean > Median > Mode = 12668 > 7270 > 4860 . This relationship shows that the data is positively skewed. This in turn means that the number of countries with low Gross National Income is higher as compared to those higher Gross National Income. Mean is a measure of the central tendency that is outlier biased. The statistical Median represents centre value of the data. Mode actually represents the majority values in the data. In this case the Median seems more appropriate to be focused as the central tendency as Mean seems to deliver an impression that the GNI of all countries is good whereas the Mode value paints an opposite picture. The Line Graph of Gross National Income asserts the selection of Median as a central tendency as the majority of spikes are almost at same level i.e. around 40,000. The exceptions are quiet evident in the above mentioned graph due to which the Mean cannot be selected as the central tendency. The value of Standard deviation is also high due to these exceptions. The Histogram (Figure 1) of the frequency table (Table 2) shows an asymptotic decay in the frequencies. As a result of which it can be claimed that the data is following Exponential Distribution. Conclusion It is concluded that as the rat e of Gross National Income is proceeding towards higher degree, the number of countries on the scale is diminishing. In his paper, he proposed three definitions for bulimia nervosa: 1) powerful and intractable urges to overeat; 2) attempts to avoid the ââ¬Ëfatteningââ¬â¢ effects of food by inducing vomiting, abusing purgatives, or both; and 3) a morbid fear of fatness (Cooper, 2009). His definitions set a trend over the next few years, as clinicians and researchers used them as guidelines in identifying people with bulimia nervosa. Now the cottage maiden is stuck in her old life, and is unhappy because now she has had a taste for higher things she is not contented with what she had before anymore. She sits and howls in dust while Kate is now enjoying what the cottage maiden used to have but to a higher extent You sit in gold and sing. In the next few stanzas the cottage becomes bitter towards her cousin and implies that She really loved him whereas her cousin Kate was bought by the lord, she says that if their situations had been switched she wouldnt have taken the Lord if he had been with her. The Maiden seems angrier with her cousin than she is with Lord but she feels betrayed by both of them. Although in the last stanza the maidens tone changes she begins to gloat. She realises that she has the one thing that her cousin Kate would like but cannot have, a baby. She knows her cousin worries about this but seems unsympathetic as she goes on to say how she will not being giving her son up and she is protective over him cling closer, closer yet. She knows that the lord would give lands for one but she seems to be saying tough to both of them and maybe thinks Kate is getting the punishment she deserves from god, seens as in those days a baby was seen as a gift from god. The cottage maiden loves her son more than anything else in her life and shows this by saying my shame, my pride she thinks she should be ashamed of him but she is not she still loves him dearly. In the seduction and Cousin Kate the male characters are portrayed very negatively.Ã Eileen McAuley describes a youth that met the young girl at the party. He also spits in the river, trying to impress her but really just showing his vulgarity. He had obviously planned the night, which makes him seem quite seedy and perverted, he seems to be in control of the night, he sat down, he led her, and hed bought her more drinks. He seems to be the source of intoxicated state as he had been buying her drinks all night and he handed her the vodka at the river. The fact that he thinks he need to get her drunk before she will have any contact with him shows that maybe he doesnt really think that highly of himself anyway. The conversation between the couple is very one dimensional and shows the boy to be quite selfish as he only talks about subjects which concern or interest him and shows no interest in any subject relating or relevant to the young girl. The way the author describes how he spends his free time also gives us an insight into what type of boy the young girl is involved with. He says he spends most afternoons down by the river whilst he should be in school so the fact that hes a truant makes him seem less academic and clever and more juvenile. He also explains how he goes there alone so we get the inclination that maybe he doesnt have that many friends either or he could be antisocial. He says blatantly in from of the girl that he goes there with his dads magazines making him sound seedy and sweet paint thinner indicating that he abuses solvents. All in all he doesnt make himself sound to attractive to this young intelligent girl who is looking for the perfect partner to lose her virginit y to. He is very unromantic when it comes to seducing the young girl; in fact he is anything but seducing her hes just trying to grope her. The author writes about how he contrived to kiss her which again goes back to the way he had planned the night in advance but also shows us that he didnt have any interest in the girl he just wanted to use her for sex.Ã In Cousin Kate we do not find out about the Lord in such great detail but we get the inclination that he used his position and his money to trick the cottage maiden into a relationship when the author uses the phrase he lured me to his palace home. The word lured implying seediness and trickery. The author creates the Lord as a very fickle man who treats his women like clothing, wore them as eye candy until they were dirty and boring only to throw them away and change them for a better model. He became bored with the cottage maiden after she had had sex with him and decided to pursue her cousin Kate. He comes across as quite persistent to get his own way as he does not give up on Kate and he ends up marrying her, so he can finally get his own way which shows that he will go to extremes to get what he wants. He obviously feels that love is based upon possessions and not emotions as he tries to buy Kate with his lands and money not with his personality, this make him seem shallow. The setting for both poems is important, the seduction being set in the city and cousin Kate in the country has great relevance.Ã I touched upon the setting for the seduction earlier; the docks being associated with prostitution implies that the boy felt the girl was of that standard. Also the setting is not glamorous it is quite seedy and putrid. The way the author says towards the frightening scum on the water reflects on the dangerous situation that she has got herself involved in but also the word scum actually mirrors the boys character. The author also goes on to describe the Mersey, green as a septic wound and I think this simile on the setting also reflects in the situation as a whole, infectious and unrewarding. Also the setting for the second part of the poem is a bedroom, isolated from the rest of the world, showing the young girls emotions, her longing to be cut of from the rest of her surroundings. The setting is a contrast from the first part of the poem, whereas the city is bustling, busy and noisy, her room is secluded, quiet and lonely. The change in scenery reflects the change of tone and emotion. The choice of setting for Cousin Kate is quite straightforward; the countryside is perceived as a quite place full of nature and animals, unlike a city. A city is a more typical setting for a situation like the cottage maidens so the fact that it takes place in the countryside is even more ludicrous. Both authors use the settings to create effect but the effect they have on us is the complete opposite of each other. In the seduction the reader is supposed to relate the situation to the setting but in Cousin Kate it is used for shock effect and to make the situation seem more extreme as the countryside isnt the typical place youd expect her relations to be taking place.

Why I Hate HR MGT/431 Why I Hate Hr The issue we are addressing in this assignment below is the problems of Human Resource Management; the author has written the topic ââ¬Å"Why we hate HR? â⬠. He has listed several issues faced such by the human resource management ââ¬â managers and there is quite a number of times having to distance themselves from the employees. He has started his case by talking about ââ¬Å"why human-resource does not do such a good jobâ⬠, and how can we fix it? hen he continues with the Sarcastic criticism of the general outlook of people towards HR , and considers that the HR people just find a great excuse of partying, calling it a HR leadership training program at the most expensive resorts. Considered by many as a waste of time and money. Author Keith Hammonds, Deputy Editor of Fast Company magazine lit up HR managers with his long August 2005 article entitled, ââ¬Å"Why We Hate HR. â⬠He made a number of harsh accusations about HR peop le. As we have seen the article is provocative. I know many people think such accusations are true for some in the line of work, though as generalizations all are wrong. Should HR say nothing, or what exactly should they say instead? In fact Human Resource is making vast leaps forward as we speak. Instead of bashing pet peeves in the profession we should look into what is working. Punching at a problem rarely encourages improvement, though it gets lots of notice and expected email, both from irritated HR people and those who love to instigate them. Itââ¬â¢s time for an equally pointed response. The author drags out most of the cliche, tired-but-not-yet-dead accusations. He ploughs out four in particular: that HR people are ââ¬Å"not the sharpest tacks,â⬠that they are paper and policy mongers, that they are by treating everyone exactly equally ââ¬Å"the mistaken beliefâ⬠this is fairness, and that the HR managers cannot see the bigger picture. The last is truly the key issue. The others, nonetheless, grow from this. If they miss the larger picture of creating value, they are missing it not only for the companies they work for, but the individuals and their needs as well. It is irrelevant to compare Human Resource to finance and other support operations. As all HR managers make pretty much the same accusations about all of these sectors. They joke about ââ¬Å"blinker eyedâ⬠accountants who only focus on lockstep processes and can't see the value of investing in pioneering ventures. HR managers at the same time support divisionââ¬â¢s needle line executives for their tendency to brush off ââ¬Å"technicalâ⬠issues in their hurry to take shortcuts just to make their bonus numbers. Such digs may be humorous, but none of this is constructive. ââ¬Å"Not the Sharpest Tacksâ⬠Looking at HR in perspective against Keithââ¬â¢s claim that HR Managers are generally dull, side-lined executives who couldnââ¬â¢t make it in other fields. Keith alludes to, but doesnââ¬â¢t spell out that HR is relatively new as a profession without the 400 year history that, for example, accounting has. It was born out of payroll administration to take on a chaos of work that line executives didnââ¬â¢t want to make time for such as hiring, familiarizing with company atmosphere, training, terminations, HR legal issues, human rights, health and safety rules and literally dozens of other tasks loosely related to people. It can be a punching bag for all departments and Head Honchos and add to that few functions have to deal with the complexity of issues that HR does. Clear cut accounting rules have become increasingly complex lately, but nothing to compare with the massive grey areas and differing legislation that HR executives routinely have to deal with ââ¬â many of which offer few absolute, clear-cut answers to tell your CEO or staff. Do really dumb people get stuck in HR? As per Keithââ¬â¢s views many line managers, still sideline weaker managers into the function and assign them mainly paper-pushing tasks, ââ¬Å"party-planningâ⬠and police duty as he notes. Nevertheless those who may look like losers frequently aren't. HR is often asked to impose rules, sometimes some that donââ¬â¢t fit with most employees, mostly not thought up by HR at all, but by irritated fuming CEOââ¬â¢s demanding spontaneous responses to routine organizational problems better handled in other ways. In one situation HR was routinely held responsible for a poorly designed bonus plan that time after time paid out top awards, including even south sea cruises, to some of the worst performing area head, which were only good at sweet talking. Dumping weak executives into HR shows as much or more a failing of line managers than of the individuals who end up in the HR function. This will be fatal going forward and won't be allowed to continue. A bigger issue is whether senior teams can learn to effectively absorb the input of their HR members as valuable. Agreed not everyone is great, but HR certainly isnââ¬â¢t the only area with some weaker players by any means as every function holds its share of those who couldn't make it elsewhere, but have hung on where they started, barely coping with the basics. What Keith doesn't seem to be aware of is that most executives never reach the top jobs in any case, nor could they. Organizations thrive because they're tough on people in every function and ideally only the best rise to the top. Conclusion Keith Hammonds, author of, ââ¬Å"Why We Hate Hrâ⬠, clearing has no good feeling towards Human Resource Managers. Team B strongly believes if we did not have HRMââ¬â¢s in organizations today, there would clearly be a lot of confusion and no development training in todayââ¬â¢s workforce. Keith spends a lot of time talking down on human resources but does not clearly provide any facts about his opinions. Though we tend to think of a tuxedo now as the highest level of formal wear, tuxedos were only adopted in the 1920s. Previously, menââ¬â¢s formal wear was called ââ¬Å"white-tieâ⬠and consisted of a white tie and vest, along with a coat and tails. The more comfortable tuxedo replaced the coat-and-tails, and is now what we call black-tie formal. Tuxedos enabled men to dance more freely, as dancing itself became more varied and active. Top hats were considered formal hat-wear. Menââ¬â¢s hair was short and slicked back, emulating the gangsters and movie stars who were the celebrities of the day. Like for women, fur coats were a signifier of status, with raccoon coats being sought after for their pattern and color. The growing economy in conjunction with technological advancement and an increase in overall wealth created a growing culture of consumerism, where people were eager to display their wealth and status; part of this display was the cultivation of a look, and an understanding of trends. Accessing fashion was, for the first time, available to people of all classes, and there was a power in self-expression for the newly rich and the rising middle class. Additionally, many young men and women left their hometowns for the city with promises of jobs and adventure. A youth culture defined by unlimited promise quickly arose. Media Influences The film industry was just beginning en masse in the 1920s, and people of all socioeconomic status could go to see motion pictures. Movie stars like Clara Bow, Greta Garbo, Rudolph Valentino, and Buster Keaton heavily influenced the styles of the day. Hollywood as considered the height of glamour, and movie stars were a new concept that people were eager to emulate in the hedonistic twenties These changes accompanied by newspaper syndicates allowed people to all access the same information- for the first time, people in cities and rural towns across the country were reading and seeing the same content as one another. Newspapers ran the same stories, people saw the same movies, and were able to participate in national culture. This especially was important as the media glamorized prohibition gangstersââ¬â¢ rise to prominence. Their lifestyle and culture began to influence fashion and a culture of excess. Modern art also influenced 1920s fashion. Like everyone else, artists were trying to make sense of the devastating war in their own ways, which led to movements like Dada, surrealism and expressionism. Art deco was a major influence on fashion, as it focused on shapes and dimension and was about creating a visual experience. More importantly, the 1920s established fashion as an ever-changing part of our cultural lexicon, something that influences people all over the world. A common expression is that fashion is cyclical, which explains why certain styles like leggings have made their way back from the 1980s in recent years. With that said, the fashion influence of the 1920s is everywhere, from a recent rise in bright shapes and patterns, and the resurgence of loose-fitting pants and blazers. Here are some fun ways to channel the 1920s in your everyday outfits, while avoiding looking like youââ¬â¢re wearing a costume. Tube dresses, swing dresses, and shift dresses are a great way to pull in a twenties influence, since theyââ¬â¢re not form fitting. These dresses come in a variety of styles and are easy to accessorize. The same with loose, straight-legged pants! These clean lines are all about the shape, and when paired with the right accessories, will create a dramatic look youââ¬â¢ll love. Accessories are a great way to add 1920s flair. Big earrings, long necklaces- especially pearls- and headscarves will add dimension to your look. Bright colors all the way! Bobbed hairstyles made a comeback recently, and weââ¬â¢re all about it. Bobbed hair looks great with earrings, hats and headbands, and will invoke the roaring twenties. For men, it will be a bit harder to add 1920s flair to an outfit, since menââ¬â¢s clothes tend to be a little more mainstream, and 20s inspired pieces will be difficult to find. My best suggestion for adding 1920s flair to a menââ¬â¢s look is to add a hat! Fedoras and flat caps are stylish in every decade, and men can definitely add suspenders or colorful bowties. Remember, 1920s fashion for both men and women was about creating a Look, and using clothes to express yourself.
